Terms of Service

1. Who we are and what this agreement is

Askroom Live (“the Service”, “we”, “us”) is provided by RealHatApps. These Terms are a binding agreement between you and us. By creating an account, ticking the box at sign-up, or using the Service, you accept them. If you do not agree, do not use the Service.

These Terms should be read together with our Privacy Policy and our Content Guidelines, which form part of this agreement.

2. The Service

The Service lets teachers create assessments (quizzes, polls, exams and similar), run them live with students who join using a code, and see the results. It is offered free of charge to teachers and students. We may add, change, suspend or discontinue any part of the Service at any time. Where a change materially reduces what you can do, we will make reasonable efforts to give notice on the site or by email.

3. Teacher accounts

• You must be at least 18 years old and able to enter into a contract to create an account.
• You must give accurate information and keep your email address current, because we use it for security codes and important notices.
• You are responsible for everything done through your account. Keep your password private and tell us at once if you believe your account has been accessed without permission.
• One person, one account. Do not share accounts or transfer them.

4. Students

Students do not create accounts. They join a session with a code and a display name chosen by them or their teacher. The teacher running a session is responsible for supervising it, for deciding what display names are appropriate, and for using the Service in line with the policies of their school and the laws that apply to them, including any requirement to obtain consent from parents or guardians for children below the age set by local law. Do not ask students to enter personal information beyond a display name.

5. Acceptable use

You agree not to use the Service to create, upload, share or run anything that:

• is sexual, pornographic, or otherwise adult in nature, in text or in images;
• attacks, demeans or ridicules any religion, belief, caste, ethnicity, nationality, gender, sexual orientation, disability or age, or promotes hatred or violence against any group or person;
• bullies, harasses, humiliates or threatens any student, teacher or other person, or singles out a student in a way they could not reasonably be expected to accept;
• contains graphic violence, gore, self-harm, or content that glorifies drugs, weapons or crime, beyond what is genuinely required for an age-appropriate lesson;
• collects personal information about children beyond a display name, or asks students to reveal such information;
• infringes anyone's copyright, trademark or other rights, including copying paid materials you are not licensed to reproduce;
• is false or misleading in a way that could cause harm, or impersonates any person or organisation;
• is unlawful under the law that governs these Terms or in the place where you or your students are;
• contains malware, attempts to probe, scan or break the security of the Service, scrapes the Service, or places unreasonable load on it;
• is used for anything other than teaching, learning, training or assessment.

The Content Guidelines explain these rules with examples.

6. Your content

You own the questions, images and other material you add (“Content”). So that we can run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to store, copy, display and transmit your Content, but only as needed to provide the Service to you and to the students you invite. We do not sell your Content and we do not use it for advertising.

You confirm that you have the right to use everything you upload. We may remove or hide Content, or refuse to display it, if we reasonably believe it breaks these Terms, and we may suspend or close an account that does so. We will try to tell you when we take action, unless doing so would be unlawful or would put others at risk.

7. Reports and moderation

Teachers and students can report content or behaviour through the Report an issue page. We review reports and may act on them, including removing Content and restricting accounts. We are not obliged to review all Content in advance and we do not guarantee that everything on the Service is appropriate.

8. A free service, provided as it is

The Service is provided free of charge, “as is” and “as available”. To the fullest extent permitted by law we make no promises that the Service will be uninterrupted, error-free, secure, or fit for any particular purpose, or that results will be accurate. Live sessions depend on networks and devices we do not control. Keep your own copies of important assessments and results, for example by using the export feature.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of, or inability to use, the Service. Where liability cannot be excluded, our total liability for all claims relating to the Service in any twelve-month period is limited to ₹1,000 (one thousand Indian rupees). Nothing in these Terms excludes liability that cannot be excluded under the law that applies to you.

10. Your responsibility to us

If your Content or your use of the Service breaks these Terms or the law and a third party brings a claim against us as a result, you agree to compensate us for the reasonable costs and losses we suffer because of it.

11. Ending the agreement

• You can delete your account at any time from your account page. This permanently removes your assessments, sessions, results and uploads.
• We can suspend or close your account if you break these Terms, if we are required to by law, or if we discontinue the Service. Where practical we will give notice and a chance to export your data.
• Sections 6, 8, 9, 10 and 13 continue to apply after the agreement ends.

12. Changes to these Terms

We may update these Terms. The date at the top shows the current version. For material changes we will show a notice on the site or email the address on your account before the change takes effect. Continuing to use the Service after that date means you accept the new Terms.

13. Governing law

These Terms are governed by the laws of India. Any dispute will be brought in the courts of India, unless the law that applies to you gives you the right to bring it elsewhere. If any part of these Terms is found unenforceable, the rest continues to apply.
